Non-Immigrant Visas: TN Visa

The TN visa is designed for citizens of Mexico and Canada under the North American Free Trade Agreement (NAFTA). A citizen of a NAFTA country may work in a professional occupation in another NAFTA country provided that

  1. The profession is on the NAFTA Professional Job Series List,
  2. The applicant possesses the specific criteria for that profession,
  3. The prospective position requires someone in that professional capacity, and
  4. The applicant is going to work for a United States employer.

Key Points

  • Spouses and children under 21 years of age of the principal applicant are entitled to derivative benefits and receive TD-2 visa status. They are unable to accept employment but may attend school.

  • A Canadian or Mexican may be given TN status for a maximum initial period of one year. TN professionals can receive extensions of stay in one-year increments, with no outside limit on the total period of stay.
