H1-B Visas: Frequently Asked Questions

Q. If I want your law firm to process an H-1B Visa for me, what information do you require?

A. Here is the list of information needed. Please note, only copies of the required documents are needed.

  1. Degrees/Transcripts
  2. Educational or work experience evaluation
  3. Résumé
  4. Training/continuing education certificates or state licenses
  5. Passport/U.S. visa
  6. Form I-94 (front and back)
  7. Offer of employment letter
  8. Statement by employer, on company letterhead, indicating company’s requirements for the position (degrees and experience) justification for hiring alien based upon their qualifications
  9. Evidence that the position requires a Bachelor’s degree (i.e., company job description, résumés of current employees in same position, ads from newspapers, etc. in similar positions)
  10. Job description, title & salary
  11. Client site address (if applicable)
  12. Employment period (to include start date; initial H-1B visa can be requested for 3 years)
  13. Previous employment experience letters
  14. Company documentation (only one required):
    • Annual report
    • Brochure
    • Articles of Incorporation
    • Bank statement
  15. Company information:
    • Tax I.D. #
    • # of employees
    • Year established
    • Gross/net income
  16. Applicant’s current and foreign address
  17. Name/title of company representative authorized for signatures
  18. Dependent information (if applicable):
    • Passport/visa/I-94
    • Marriage certificate
    • Birth certificate

If currently in H-1B, L-1A/B, E-1/2 or TN visa status,then some additional information is needed:

  1. Current paycheck stub/voucher
  2. Visa approval notice
  3. Social Security number

If currently in F-1 visa status, then some additional information is needed:

  1. Employment Authorization card
  2. Form I-20
  3. Social Security number
